1. Who we are
GiveHalo (“GiveHalo,” “we,” “us”) provides software that helps organizations find aligned donors and sponsors, research them against public sources, score fit, and draft outreach. You can reach us any time at waynard@cappedoutmedia.com.
2. Eligibility and accounts
You must be at least 18 and able to form a binding contract to use GiveHalo. You are responsible for everything that happens under your account, for keeping your credentials secure, and for the accuracy of the organization and sender details you provide. Tell us right away if you suspect unauthorized access.
3. What the service does, and what it does not do
GiveHalo surfaces prospects and drafts messages. It is a tool, not a decision maker. Every draft is a suggestion for a human to review, edit, and approve before anything is sent. You decide who to contact and what to send.
We work hard on accuracy. Claims in a draft are tied to a public source or flagged as unverified. Even so, we do not guarantee that any fact, score, or contact detail is correct, complete, or current. You are responsible for reviewing outputs before you act on them.
4. Your responsibilities when sending outreach
By using GiveHalo to contact people, you agree that you will:
- only send messages you are authorized to send, under a sender identity you control and have verified;
- comply with all laws that apply to your outreach, including the CAN-SPAM Act, similar anti-spam laws, and any rules of the platforms or portals you use;
- honor opt-out and unsubscribe requests promptly;
- not use the service to harass, deceive, or impersonate anyone.
You, not GiveHalo, are the sender of record for any message you choose to send.
5. Acceptable use
You agree not to:
- break the law or infringe anyone’s rights;
- reverse engineer, resell, or abuse the service or its API beyond your plan;
- upload malware or try to disrupt or gain unauthorized access to our systems;
- use the service to build a competing product by scraping our outputs in bulk.
6. Plans, credits, and payment
GiveHalo offers subscription plans and prepaid credits. Credits are consumed as you generate leads and use paid features. Prices are shown before you buy. Subscriptions renew until you cancel, and canceling stops future charges but does not refund the current period unless the law requires it. You are responsible for any taxes on your purchase.
Payments are processed by Stripe. We never see or store your full card number. If a charge fails, we may pause paid features until it is resolved.
7. Third-party services
We rely on trusted vendors to run GiveHalo, including Stripe for payments, Resend for email delivery, and Anthropic for the language models behind our agents. Your use of those features is also subject to those providers’ terms. We are not responsible for outages or acts of third parties outside our control.
8. Your content and data
You keep ownership of the information you put into GiveHalo. You grant us a limited license to process it so we can provide the service, including sending relevant parts to our AI provider to generate research and drafts. We handle personal information as described in our Privacy Policy.
9. Our intellectual property
The GiveHalo software, brand, and design are ours. These terms do not give you any rights to them beyond using the service as intended.
10. Disclaimers
The service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error free, or that any prospect will respond or convert.
11. Limitation of liability
To the fullest extent the law allows, GiveHalo is not liable for any indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data. Our total liability for any claim is limited to the amount you paid us in the three months before the event that gave rise to the claim.
12. Indemnification
You agree to defend and hold us harmless from claims arising out of your use of the service, the messages you send, or your breach of these terms.
13. Termination
You can stop using GiveHalo at any time. We may suspend or close an account that breaks these terms or creates risk for the service or other users. Sections that by their nature should survive termination will survive.
14. Changes to these terms
We may update these terms as the product grows or the law changes. If a change is material, we will give reasonable notice. Continuing to use the service after a change means you accept the new terms.
15. Governing law
These terms are governed by the laws of the State of Utah, United States, without regard to its conflict of laws rules. Disputes will be handled in the state or federal courts located in Utah, and you consent to their jurisdiction.
